Competencia de la Unión Europea en materia de inversiones extranjeras y sus implicaciones en el arbitraje inversor?Estado.

Abstract

La entrada en vigor del Tratado de Lisboa ha supuesto un cambio profundo en el reparto competencial entre la UE y los Estados miembros en materia de las inversiones extranjeras. La principal novedad hace referencia a la inclusión de las inversiones extranjeras directas dentro de la Política Comercial Común; se convierte, así, en una materia de competencia exclusiva de la UE. Son muchas las cuestiones que plantea esta nueva regulación. Como primera respuesta a la incertidumbre creada, la Comisión ha adoptado dos instrumentos (una Comunicación y una propuesta de Reglamento) que, con mayor o menor acierto, muestran el sentido y alcance de esta modificación legislativa, la dirección de una política común de inversiones futura, a la vez que tratan de dotar de seguridad jurídica en esta nueva época de transición.

The Lisbon Treaty has introduced a very important change in the EU’s and the Member States’ competences related to the foreign investments. The main change is the inclusion of the foreign direct investments topic within the Common Commercial Policy, becoming a field of exclusive competence of the EU. There are many questions arising from this new regulation. Responding to the uncertainty created by the Lisbon Treaty, the Commission has recently adopted two instruments (a Communication and a proposal for a Regulation). These instruments, with greater or lesser success, show the meaning and the scope of this legislative modification and the direction of the future European international investment policy; at the same time, they try to give legal certainty in this transitional era.
