Abstract: El TJCE ha vuelto a pronunciarse sobre la compatibilidad del régimen procesal civil comunitario y las antisuit injunctions: en este caso, una concebida para obligar a su destinatario a cumplir con un compromiso arbitral que le vincula. El TJCE sigue al Abogado General y establece que la injunction no es compatible con el Reglamento (CE) nº 44/01. Su respuesta adolece de falta de justificación convincente y es, además, apta para provocar interferencias con los instrumentos convencionales sobre arbitraje internacional, y con el funcionamiento fluido de este medio alternativo de resolución de controversias.

The ECJ has ruled again on the compatibility of the community civil litigation system and antisuit injunctions: in case, one designed to force the defendant to comply with a binding arbitration agreement. The ECJ follows the Advocate General opinion, therefore stating that the injunction is not compatible with Regulation (EC) No. 44/01. The grounds for the answer are not convincing; besides, the ECJ response is apt to interfere with the conventions on international arbitration, and with the smooth operation of this alternative dispute resolution mechanism.
