Confidencialidad en el arbitraje.

Abstract

Tradicionalmente, se considera que una de las ventajas del arbitraje es su confidencialidad. Esto no así en todo tipo de arbitrajes y en todo caso en el arbitraje sometido a ley española, los sujetos obligados, las excepciones al principio y las consecuencias del incumplimiento de la obligación de confidencialidad admiten diversas interpretaciones.

Traditionally, it is considered that one of the arbitration adventages is its confidentiality. This is not the case in all types of arbitrations and in any case in arbitrations under Spanish Law, the affected persons, the exceptions to this principle and the effects of its violation are able of different interpretations.
