Abstract

El Considerando 12 del Reglamento Bruselas I refundido aborda la cuestión relativa al alcance de la exclusión del arbitraje de su ámbito de aplicación material. Un estudio detallado de los cuatro párrafos que lo componen demuestra, no obstante, que las modificaciones introducidas en este ámbito son mínimas. Así, el control incidental del convenio arbitral es una cuestión que debe considerarse incluida en el ámbito de aplicación material del nuevo Reglamento. Por su parte, las anti–sui injunction dictadas en apoyo de un arbitraje siguen estando excluidas del ámbito de aplicación material del nuevo texto. Los argumentos que esgrime el Abogado General en sus Conclusiones al asunto Gazprom no son, en este sentido, convincentes.

Recital 12 of the Recast Regulation address the issue concerning the exclusion of arbitration from the scope of the Regulation. A detailed study of the four paragraphs clearly shows that changes introduced in this field are minor. In this regard, incidental control of the validity of an arbitration agreement is included in the scope of the Regulation. On the contrary, anti–suit injunction in support of arbitration are still excluded of the scope of the Regulation. Therefore, Conclusions of the Advocate– General in the case Gazprom are not convincing.
