El orden público y el arbitraje en el Derecho mexicano : avance, retroceso o redefinición de límites y consecuencias, Amparo directo 71/2014

Abstract

La intención del presente trabajo es realizar un estudio de la evolución del concepto de “orden público”, en México, en los últimos años, tomando como punto de referencia, las resoluciones emitidas por la Suprema Corte de Justicia de la Nación, en el periodo comprendido entre el 2012 y 2017. En este trabajo, se podrá apreciar que el concepto de orden público y su violación, contenía estándares muy altos para su actualización, y posteriormente, dicho concepto evolucionó, para establecer estándares más racionales, acordes con una política coherente y democrática.

The intention of this work is to conduct a study of the evolution of the concept of public order in Mexico in recent years, taking as a reference point, the resolutions issued by the Supreme Court of Justice of the Mexican nation, in the period between 2012 and 2017. In this work, it will be appreciated that the concept of public order and its violation, beginning containing very high standards for its updating, and thereafter, this concept evolved, to establish more rational standards, according to a policy coherent and democratic.
