dc.description.abstractEl tema objeto de estudio se afronta desde la perspectiva de la Ley 60/2003, de 23 de diciembre, de arbitraje, y de la fijación en España del lugar de un arbitraje internacional. La nueva regulación española ha dado importancia al lugar del arbitraje, como espacio contenido dentro del territorio de un Estado, referido a partir del municipio. El lugar del arbitraje es esencial, necesario punto de conexión con el ordenamiento jurídico. La Ley atribuye a las partes libertad para su determinación -directa o indirectay modificación, antes de la notificación de la aceptación por los árbitros. A falta de acuerdo entre las partes, el lugar del arbitraje se determinará por los propios árbitros. Muy relevantes son las consecuencias jurídicas que la Ley atribuye al lugar del arbitraje, señaladamente: determina la aplicación de la ley del arbitraje; es criterio de definición del arbitraje internacional; de atribución de competencia territorial para las funciones jurisdiccionales de apoyo y control del arbitraje, y mención obligatoria del laudo. De otra parte, la consideración del lugar del arbitraje como punto de conexión no obsta para su “deslocalización”, posibilitándose la práctica de actuaciones fuera de ese lugar. Finalmente, se destaca la existencia de factores y circunstancias que hacen al territorio español “idóneo” para la fijación del lugar del arbitraje internacional.es_ES
dc.description.abstract(The Place of Arbitration) This subject is approached from the perspective of the Arbitration Act 60/2003 of December 23, 2003 and of naming Spain as the place of international arbitration. The new Spanish legislation attaches importance to the place of arbitration, understood as a space within the territory of a specific State.The place of arbitration is an essential connection point with the legal system. The Act gives the parties freedom to choose—directly or indirectly—the place of arbitration, and to alter it, before the arbitrators accept their appointments. If the parties do not agree on the place of arbitration, the arbitrators will choose it. The Act attributes significant legal consequences to the place of arbitration: it determines the law that governs the arbitration; it is a criterion for defining international arbitration; it attributes territorial jurisdiction for the functional aspects of support and control of the arbitration proceedings; and obligatory mention of the arbitral award. Considering the place of arbitration a connection point does not prevent it from being relocated, allowing actions outside that place. Finally, there are factors and circumstances that make Spain the “ideal” territory when establishing the place of international arbitration.en_EN
