Abstract

El árbitro de emergencia se ha consolidado como una figura eficiente, más no siempre eficaz. A la luz de la Convención de Nueva York sobre Reconocimiento y Ejecución de Laudos Extranjeros, la Orden presenta un vacío: su ejecutabilidad. La necesidad de dar a la orden un efecto útil y formal, es imperante. En este análisis, demostraremos que puede ser llenado por la Ley o por la autonomía de las partes.

The Emergency Arbitrator has been established as an efficient figure, but not always effective. Under the New York Convention on the Recognition and Enforcement of Foreign Arbitral Awards, the Order presents a vacuum: its enforceability. The need to give the order a useful and formal effect is imperative. Within this analysis, we will demonstrate that it can be filled either by the Law or by the parties’ autonomy.
