Abstract

Las últimas tres décadas han sido esenciales para América Latina y el Caribe, durante las cuales la mayoría países de la región han realizado importantes progresos en el logro de la estabilidad política y económica crecimiento. Las iniciativas de resolución de disputas han sido clave componentes en esos procesos, y este artículo presenta una breve descripción de los contextos en los que estos se han realizado esfuerzos durante los últimos 30 años, enfocándose en sus metas, propósitos y desarrollos. También explora algunos de los desafíos actuales y aboga por un enfoque más sistémico en el futuro. Por último, este estudio revisa los esfuerzos inconexos de reforma legal en América Latina, sugiriendo que una perspectiva sistémica podría vincular y fortalecer efectivamente los esfuerzos de reforma judicial y la promoción de ADR.

The last three decades have been unprecedented for Latin America and the Caribbean, a time when most countries in the region have made significant progress in achieving political stability and economic growth. Dispute resolution initiatives have been key components in those processes, and this article presents a brief overview of the contexts in which these efforts have been carried out for the past 30 years, focusing on their goals, purposes, and developments. It also explores some of the current challenges and argues for a more systemic approach going forward. Finally, this study reviews the disjointed legal reform efforts in Latin America, and suggests that a systemic perspective could effectively link and strengthen judicial reform efforts and the promotion of ADR.
