Arbitrando la inversión

Abstract

Después de un número tan grande de BITs, estamos en camino de encontrar un equilibrio entre los intereses de los países inversionistas y los de los países receptores. Experiencias como las del NAFTA, que convierten a países tradicionalmente inversionistas en países receptores, son particularmente interesantes porque obligan a los países desarrollados a ponerse en el lugar que antes correspondía sólo a los países en desarrollo y comprender así sus puntos de vista. A pesar de todas las críticas, dada la falta de confianza recíproca entre países inversores y países receptores respecto de la imparcialidad de sus jueces y la inherente debilidad del inversionista en la relación “inversionista extranjero-Estado receptor”, parece que el arbitraje de inversión sigue siendo la mejor opción para atraer los capitales.

After a big number of BITs, we are on the way to find a balance between the interests of the investing countries and those of the receiving countries. Experiences like those of NAFTA, that transform traditionally investing countries also into receiving countries, are particularly interesting because they force to highly developed to be in some cases in the place that before only corresponded to the developing countries and hence may contribute to better understand the points of view of the receiving countries. In spite of all the critics, given the reciprocal lack of confidence between investing countries and receiving countries with respect to the impartiality of their respective judges and the investor's inherent weakness in the relationship "foreign investor-receiving State” it seems that investment arbitration continues to be the best option to attract capitals.
