Abstract

El estudio en torno a los poderes de los árbitros frente a la teoría del abuso del derecho, en el Derecho internacional privado, va dirigido al análisis de la extralimitación del ejercicio del juzgador ad hoc, en este caso del árbitro, que obliga a examinar el poder jurisdiccional y su ejercicio como figura central. Por ello, el presente estudio se concentrará en los casos de extralimitación de la competencia arbitral, así como al estudio de los poderes de los árbitros, en la administración del proceso arbitral y por último, el análisis del poder de interpretación y de la aplicación del Derecho de fondo por el árbitro en el plano internacional.

The study about the powers of the arbitrators and the theory of abuse of rights in Private International Law aims at analysing the excess of the exercise of the judge ad hoc, in this case the arbitrator, which requires an examination of the judicial power and the exercise of its central figure. Therefore, this study will focus on cases of overreaching of the arbitrator’s power, as well as in the study of the powers of the arbitrators in the administration of the arbitration process and, finally, in the power of analysis and interpretation of the Law applicable to the substance of the matter at the international level.
