Arbitraje y Constitución : consideraciones en torno a la Sentencia del Tribunal Constitucional 1/2018, de 11 enero 2018.

Abstract

Una nueva sentencia del Tribunal Constitucional español viene a incidir en la necesidad de que exista un acuerdo de voluntades para instaurar un procedimiento arbitral. En esta ocasión, declara inconstitucional el art. 76 e) de la Ley de Contrato de Seguro, referido al seguro de defensa jurídica, que establece el derecho del asegurado a someter a arbitraje cualquier diferencia que pueda surgir entre él y el asegurador sobre el contrato de seguro. El Tribunal entiende que el citado artículo infringe el art. 24.1º de la Constitución, al privar a una de las partes, concretamente al asegurador, del acceso a la jurisdicción y en consecuencia a la tutela judicial efectiva.

A new sentence of the Spanish Constitutional Court comes to emphasize the need for an agreement of wills to establish an arbitration procedure. On this occasion, it declares unconstitutional article 76 e) of the Insurance Contract Law, referred to the legal defense insurance, which establishes the right of the insured to submit to arbitration any difference that may arise between him and the insurer about the contract of insurance. The Court understands that the aforementioned article violates Article 24.1 of the Constitution, by depriving one of the parties, specifically the insurer, of access to jurisdiction and, consequently, effective judicial protection.
